Gas Safety in Rental Properties
As a landlord, you are ultimately responsible for the gas safety in rental properties for the safety of your tenants. The Gas Safety (Installation and Use) Regulations 1998 deal with landlords’ duties to make sure gas appliances, fittings and flues provided for tenants are safe. This is an important piece of legislation which is designed to ensure the tenants are safe from inadequate gas appliances. Cardwells Letting Agents would be pleased to arrange the Gas Safety Check on your behalf and would ensure that the annual renewal is handled in good time if we are acting as your managing agents.
This legislation covers for example, gas boilers, gas hobs, gas fires etc. Appliances, fittings and flues in a communal area are also included if they may be used by tenants. Landlords are responsible for the maintenance and repair of flues, appliances and pipework provided for your tenants use. These should be checked and tested by a Gas Safe Certified engineer.
Although there is no prescribed time frame for these duties, good practice would be the demonstration of regular, annual maintenance checks and subsequent repairs. At Cardwells Letting Agency we schedule the renewal in a timely manner on your behalf if we are managing agents and liaise with your tenant to ensure that the Gas Safe engineer can gain appropriate access to carry out the inspection checks.
Landlord Gas Safety Certificates
You as a landlord are also responsible for ensuring an annual gas safety check is carried out within 12 months of the installation of a new appliance or flue which you provide and annually thereafter by a Gas Safe Registered engineer. You must keep a record of the safety check for 2 years and issue a copy to each existing tenant within 28 days of the check being completed and issue a copy to any new tenants before they move in. Of course, if Cardwells are your managing agent we will handle this on your behalf so you do not need to worry about getting the renewals done on time etc. We are here to take these concerns away from you.
Under the Gas Safety (Installation and Use) (Amendment) Regulations 2018 you can have the annual gas safety check on each appliance or flue carried out up to 2 months before the date the check needs to be carried out but still retain the original deadline date as if the check had been carried out exactly 12 months after the previous check.
