Tenant Permitted Payments

The following information outlines permitted payments for Assured Periodic Tenancies (APTs) in line with current rental law, the Tenant Fees Act, recent rental law changes, and updates introduced under the Renters Rights Act. These permitted payments and tenant charges are designed to ensure transparency for both landlords and tenants while helping maintain tenancy compliance and landlord compliance with current letting legislation.

Holding Deposit

A holding deposit may be requested to reserve a property to let before the tenancy agreement is signed. Under current holding deposit rules and tenant fees legislation, the maximum holding deposit permitted is equivalent to one week’s rent. Holding deposits may be retained in certain circumstances permitted under rental law, including where the tenant provides false or misleading information or withdraws from the tenancy.

Security Deposit

Security deposits and tenant deposit rules are governed by current letting legislation and tenancy compliance requirements. If the yearly rent is under £50,000, the maximum security deposit permitted is 5 weeks’ rent. If the yearly rent is £50,000 or more, the maximum permitted security deposit is six weeks’ rent, in line with current security deposit limits. All deposits relating to Assured Periodic Tenancies must be protected within a government-approved Deposit Protection Scheme in accordance with tenancy and rental compliance regulations. Unpaid Rent & Rental Payments

If any rental payments or monies payable by the tenant under the tenancy agreement are not paid within 14 days of becoming due, the landlord or letting agent reserves the right to charge interest on outstanding rent. Interest may be charged at up to 3% above the Bank of England base rate for each day the payment remains outstanding, in accordance with permitted tenant fees and tenancy charges legislation.

Lost Keys or Security Devices

If replacement or additional keys, fobs, or security devices are required during the tenancy, tenants will be charged the reasonable cost of replacement. Should Cardwells Letting Agents assist with arranging replacement keys or security devices, an additional administration charge of £15.00 including VAT (£12.50 + VAT) per hour may apply. These tenant charges are permitted under current tenant fees legislation, where costs are reasonably incurred.

Amendments to the Tenancy Agreement

Should a tenant request amendments to the tenancy agreement after the tenancy has commenced, tenancy agreement fees may apply. Any amendments to the tenancy agreement requested by the tenant will incur a charge of £50, including VAT (£41.67 + VAT), to cover associated administrative costs.
